Tracklib Competition Terms & Conditions

Below are the full terms and conditions for entering competitions hosted by Tracklib. Please note that you must comply with these terms and conditions to enter the competitions.

The Competition Promoter

The competition promoter is Tracklib AB c/o Brain Accounting AB, Box 2070 103 12 Stockholm, Sweden (“Tracklib”).

Reference in these rules to the specific rules of the competition means those rules that are expressly set out on Tracklib’s website on the competition rules page.

How to enter

The competition will run from the opening date to the closing date as specified in the specific rules for each competition.

All competition entries must be received by Tracklib via the means specified in the specific rules for each competition by the closing time on the closing date.

All competition entries received after the closing time on the closing date are automatically disqualified.

Tracklib will not accept:
responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or proof of transmission as proof of receipt of entry to the competition.

By submitting a competition entry, you are agreeing to be bound by these terms and conditions. For help with entries, please contact the consumer helpline on support@tracklib.com.

Eligibility

The competition is only open to those persons specified in each competition’s specific rules all of whom must be aged 18 years or over, except: employees of Tracklib or its holding or subsidiary companies; employees of agents or suppliers of Tracklib or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or members of the immediate families or households of the above.

This eligibility principle also applies to any other company or person participating in the competition, together with Tracklib.

In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. Tracklib may require you to provide proof that you are eligible to enter the competition.

Tracklib will not accept competition entries that are:
automatically generated by computer; completed by third parties or in bulk; illegible, have been altered, reconstructed, forged or tampered with; or incomplete.

Entries on behalf of another person will not be accepted and joint submissions are not allowed.

Tracklib reserves all rights to disqualify you if you breach the competition rules or your conduct is contrary to the spirit or intention of the prize competition.

Competition entries cannot be returned.

The prize

The prize is as set out in the specific competition rules.

Prizes are subject to availability. There is no cash alternative for any non cash element of the prize.

In order to claim some of the prizing you must reply when Tracklib tries to contact you.

Winners

The decision of the competition judge(s) is final and not appealable no correspondence or discussion will be entered into. You acknowledge that decisions can be subjective. Tracklib must either publish or make available information that indicates that a valid award took place.

To comply with this obligation Tracklib will publish the name and county of prize winners and, if applicable, their winning entries, on its website and social media.

If you object to any or all of your name, county and winning entry being published or made available, please contact the Tracklib at support@tracklib.com.
In such circumstances, Tracklib must still provide the information and winning entry to relevant authorities on request.

Claiming the prize

Tracklib will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 14 days of the announcement date, Tracklib reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the closing date.

Tracklib does not accept any responsibility if you are not able to take up the prize.

If the prize (or part of the prize) is a cash payment, it will be made within 30 days of the announcement subject to the winner providing its account details (which will be processed) in accordance with our privacy policy (see below under the heading Data Protection and Publicity).

Limitation of liability

Insofar as is permitted by law, Tracklib, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Tracklib, its agents or distributors or that of their employees. Your statutory rights are not affected.

If the prize includes the release of a song you have entered into the competition, neither Tracklib nor any other company or person participating in the competition, can guarantee any level of success or sales.

Competition entries and intellectual property rights

By submitting your competition entry and any accompanying material, you agree to:

Allow Tracklib to use your entry in the manner specified in the specific competition rules and waive all moral rights.

You agree that Tracklib may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant Tracklib a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

Any tracks you download are subject to Tracklib’s terms and conditions and you obtain no rights (including intellectual property rights) in the tracks except the right to use them in accordance with the specific competition rules and these terms and conditions.

If the competition allows you to release a new song featuring a sample from Tracklib’s library, you will have to enter into, and comply with, a Tracklib standard sample license agreement (which can be viewed upon request from support@tracklib.com), including accounting direct to Tracklib, and any other formality set out in the sample license. You will also need to sign an agreement with the releasing label.

Data protection and publicity

Tracklib will only process your personal information as set out in our privacy policy.

General

If there is any reason to believe that there has been a breach of these terms and conditions, Tracklib may, at its sole discretion, reserve the right to exclude you from participating in the competition or require you to return any prize you may have won.

Tracklib reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. It may also substitute the prize for a prize of equivalent value if circumstances require. In both cases this will be without liability to entrants or any other persons or other third parties.

If, for any reason any competition is not capable of running as planned as a result of any causes beyond our control which affect the administration, security, integrity or proper conduct of a competition, we reserve the right to cancel, terminate, modify or suspend the competition and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the incident, with Tracklib having no liability in respect thereof.

Prizes are not transferrable or exchangeable.

A failure by Tracklib to enforce any of the general terms and conditions or specific rules will not give rise to any claim or right of action by any entrant or prize winner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.

To the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.

We cannot guarantee that the services or systems for entering a competition, will at all times be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of any problem with any network or line, system, server, software, or for any technical malfunction or failure, maintenance or repair or for reasons reasonably beyond our control. We do not accept responsibility where all or any part of the service relating to a competition is discontinued, modified or changed in any way.

These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
